STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to beverage and liquor licenses for bed and breakfasts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Definitions; Bed and Breakfast. Amend RSA 175:1, VI to read as follows:

VI. “Bed and breakfast” means a building or buildings regularly used and kept open as such in a bona fide manner for the feeding and lodging of transient guests. A bed and breakfast shall have at least 4 rentable rooms and an area of dining capable of accommodating the number of registered guests [and be housed in the primary residence of the owners or operators] and whose posted room rates shall include breakfast.

2 Licenses; Bed and Breakfasts. Amend RSA 178:21, II(c) to read as follows:

(c) Bed and Breakfasts. The commission may issue a license to any bed and breakfast which has at least 4 rentable rooms and [full service] a dining area capable of seating the total number of registered guests and shall entitle the licensee to:

(1) Sell liquor and beverages to registered guests [with meals in the dining room] in any approved area or in the rooms of guests.

(2) Sell liquor and beverages by the bottle which shall be delivered to the rooms of registered guests, provided that the charge for such liquor and beverages is not below cost.

3 Effective Date. This act shall take effect 60 days after its passage.

HB 202 FISCAL NOTE

AN ACT relative to beverage and liquor licenses for bed and breakfasts.

FISCAL IMPACT:

      The Liquor Commission states this bill, as amended by the House (Amendment #2013-0669h), will have an indeterminable impact on state revenue in FY 2014 and each year thereafter. There will be no fiscal impact on state, county, and local expenditures, or county and local revenue.

METHODOLOGY:

    The Liquor Commission states this bill amends current statute by expanding the circumstances in which bed and breakfast owners may serve alcohol to registered guests. The Commission states this bill provides an alternative license for existing bed and breakfast facility owners who may currently carry a restaurant or hotel license. The Commission states the bill’s fiscal impact upon Commission revenues will be immaterial.
