ANALYSIS

This bill requires boards and commissions granting licenses, certificates, or registrations to credit acceptable military education, training, or service; to continue the validity of licenses, certificates, or registrations for 90 days after the end of service; and to provide for expedited and temporary licenses, certificates, or registrations for a spouse of a member of the armed forces.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to occupational and professional boards and commissions procedures concerning military service and occupational experience or training.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Occupations and Professions; Military Training or Experience; Spouses. RSA 332-G:7 is repealed and reenacted to read as follows:

332-G:7 Military Service; Occupational Experience or Training; Spouses.

I. Each of the boards or commissions established in this title shall, upon presentation of satisfactory evidence by an applicant for licensure, certification, or registration, accept education, training, or service completed by an individual as a member of the armed forces, as defined in defined in RSA 21:50, II, toward the qualifications required to receive the license, certificate, or registration in question.

II. Notwithstanding any general or special law to the contrary, if a licensee or registration or certificate holder, under any provision of this title, is engaged in active service in the armed forces of the United States, as defined in RSA 21:50, II, the license, certification, or registration held by that licensee or registration or certificate holder shall remain valid until the licensee or registration or certificate holder is released from active duty and for a period of not less than 90 days following that release.

III. Notwithstanding any general or special law to the contrary, each of the boards or commissions under this title authorized to conduct licensure, certification, or registration, and examinations therefor, shall upon the presentation of satisfactory evidence by an applicant before the board or commission, expedite the issuance of a license or certification for a person: (i) who is certified or licensed in a state other than New Hampshire; (ii) whose spouse is a member of the armed forces in the United States; (iii) whose spouse is the subject of a military transfer to New Hampshire; and (iv) who left employment to accompany a spouse to New Hampshire. The procedure shall include, but not be limited to: (1) issuing the person a license, certificate, or registration if, in the opinion of the board or commission, the requirements for licensure, certification, or registration of such other state are substantially equivalent to the requirements for licensure, certification, or registration in New Hampshire; or (2) issuing the person a temporary license, certificate, or registration to allow the person to perform services while completing any specific requirements that may be required in New Hampshire but were not required in the state in which the person was licensed, certified, or registered.

IV. Every board or commission under this title shall adopt rules under RSA 541-A for:

(a) What constitutes military education, training, or service acceptable for the specific regulated occupation or profession, as required under paragraph I.

(b) The procedures and notice required for the validity of licenses, certificates, or registrations under paragraph II.

(c) Procedures for expedited and temporary licenses, certificates, or registrations for a spouse of a member of the armed forces as required in paragraph III.

2 Effective Date. This act shall take effect 60 days after its passage.
