STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT restoring the authorization of the division of emergency services and communications and the division of fire standards and training and emergency medical services to make transfers from their respective funds in cases of unanticipated contingencies.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Restoring the Authorization of the Division of Emergency Services and Communications and the Division of Fire Standards and Training and Emergency Medical Services to Make Transfers from Their Respective Funds in Cases of Unanticipated Contingencies. Amend RSA 21-P by inserting after section 49 the following new section:

21-P:50 Fire Standards and Training and Emergency Medical Services Fund and Enhanced 911 Fund; Transfers Authorized.

I. Notwithstanding other provisions of law, with approval of the commissioner and of the enhanced 911 commission, if the expenditure of additional funds over budget estimates was unanticipated and is necessary for the proper functioning of the division of emergency services and communications, the department of safety may request, with prior approval of the fiscal committee of the general court, the transfer of funds from the enhanced 911 system fund established in RSA 106-H:9 to the department of safety for such purposes.

II. Notwithstanding other provisions of law, with approval of the commissioner, if the expenditure of additional funds over budget estimates was unanticipated and is necessary for the proper functioning of the division of fire standards and training and emergency medical services, the division of fire safety, or the division of homeland security and emergency management, the department of safety may request, with prior approval of the fiscal committee of the general court, the transfer of funds from the fire standards and training and emergency medical services fund established in RSA 21-P:12-d to the department of safety for such purposes.

2 Effective Date. This act shall take effect July 1, 2013.
