STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the department of health and human services promoting awareness of the federal earned income credit.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Duties of the Commissioner; Promote Awareness of the Federal Earned Income Credit. Amend RSA 126-A:5 by inserting after paragraph XIX the following new paragraph:

XX. The commissioner shall promote awareness of the federal earned income credit to make eligible taxpayers aware of the credit. The commissioner may adopt rules, pursuant to RSA 541-A, relative to appropriate procedures and manner of promotion of the awareness campaign.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 288-FN - FISCAL NOTE

AN ACT relative to the department of health and human services promoting awareness of the federal earned income credit.

FISCAL IMPACT:

      The Department of Health and Human Services states this bill, as introduced, will have an indeterminable fiscal impact on state revenue and expenditures in FY 2014 and each year thereafter. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department of Health and Human Services states this bill requires the Commissioner to promote awareness of the federal earned income credit to make eligible taxpayers aware of the credit. The Department, through the Division of Family Assistance, currently promotes awareness of both the earned income credit and the child tax credit through an annual mailing to recipients who have earned income in the following programs: Financial Assistance to Needy Families (FANF), Food Stamps, Medicaid, NH Child care Scholarship, Aid to the Permanently and Totally Disabled (APTD), and Aid to the Needy Blind (ANB). In December 2012 this letter was sent to 30,026 households. The Department has the necessary information for many, but not all individuals who are receiving services. The Department has does not have access to federal taxpayer information due to federal privacy laws and therefore cannot determine the fiscal impact of this bill.
