STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT establishing a committee to study the apportionment formula for cooperative school districts for towns with electric generation facilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a committee to study the apportionment formula for cooperative school districts for towns with electric generation facilities.

2 Membership and Compensation.

I. The committee shall consist of 5 members of the house of representatives, appointed by the speaker of the house of representatives.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties. The committee shall study tax obligations and state aid for towns and districts that have electric generation facilities, including renewable generation facilities subject to a payment in lieu of taxes under RSA 72:74, sited within the town or district. The committee shall study the laws governing the apportionment formula for cooperative and regional school districts, and may propose changes to remedy disproportionate tax assessments and tax obligations resulting from the electric generation facility. The committee may also study how electrical generation facilities affect the tax bases of surrounding municipalities and how the use of payments in lieu of taxes for renewable energy projects has worked, including whether the provisions in statute to establish them are sufficient to protect property taxpayers and whether they ensure proportionality.

4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Three members of the committee shall constitute a quorum.

5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2013.

6 Effective Date. This act shall take effect upon its passage.
