AN ACT relative to the definition of gift received by an elected official, public official, public employee, or legislative employee.

ANALYSIS

This bill excludes certain items provided to state legislators from the definition of gift under RSA 15-B concerning gifts received by an elected official, public official, public employee, or legislative employee. The bill also clarifies the application of gifts of insignificant economic value to an individual.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the definition of gift received by an elected official, public official, public employee, or legislative employee.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Gifts, Honoraria, and Expense Reimbursements; Definition of Gift. Amend RSA 15-B:2, V(a)(2) to read as follows:

(2) Any other tangible thing, intangible thing, service, or the use thereof having more than insignificant economic value. Any such item with a value of less than $25, or less than $25 per individual recipient if given to a group for distribution, is presumed to be of insignificant economic value.

2 Definition of Gift; Transportation Clarified. Amend RSA 15-B:2, V(b)(10) to read as follows:

(10) Meals, beverages, lodging, or transportation associated with attendance at:

(A) Any event for which the primary significance is ceremonial or celebratory, provided the event is public or, if by invitation only, is planned to have an attendance greater than 50 people; or

(B) Any event where the person is attending in an official capacity representing the state and/or the senate, house, or the agency of which the person is a member. At such an event “transportation associated with attendance” shall include the use of vehicles, boats, or other means of transportation supplied for the use of the person during and for such official representation.

3 New Subparagraph; Definition of Gift; Exclusion Added. Amend RSA 15-B:2, V(b) by inserting after subparagraph (13) the following new subparagraph:

(14) The receipt of goods or the use of services including entry to an attraction or operation owned by the state, provided by a state agency to members of the general court, where such goods and service are available to all members of the general court.

4 Effective Date. This act shall take effect 60 days after its passage.
