STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT establishing a commission to study and update the rules and procedures of the legislative ethics committee under RSA?14-B and the laws governing legislative ethics under RSA 15-B.

Be it Enacted by the Senate and House of Representatives in General Court convened:

211:1 New Section; Commission Established; Legislative Ethics. Amend RSA 14-B by inserting after section 10 the following new section:

14-B:11 Commission to Study and Update the Rules and Procedures of the Legislative Ethics Committee Under RSA 14-B and the Laws Governing Legislative Ethics Under RSA 15-B.

I. There is hereby established a commission to study and update the rules and procedures of the legislative ethics committee under RSA 14-B and the laws governing legislative ethics under RSA 15-B. The commission shall be composed of the following members:

(a) Four members of the house of representatives, appointed by the speaker of the house.

(b) Two members of the senate, appointed by the president of the senate.

(c) Three public members, each of whom shall be either a former member of the legislative ethics committee or a person otherwise knowledgeable in the field of governmental ethics procedures, appointed jointly by the speaker of the house and the president of the senate.

II. The legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

III. The commission shall study the current laws, rules, and guidelines for legislative ethics under RSA 14-B and RSA 15-B as well as the procedures of the legislative ethics committee under RSA 14-B and propose updates to the laws, rules, guidelines, and procedures as necessary, in light of the increased significance of statutory legislative ethics provisions since the enactment of RSA 14-B in 1991 and RSA 15-B in 2006.

IV. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. Five members of the commission shall constitute a quorum.

V. The commission shall submit a final report of its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before December 1, 2014. The commission may issue an interim report.

211:2 Repeal. RSA 14-B:11, relative to the commission to study and update the rules and procedures of the legislative ethics committee under RSA 14-B and the laws governing legislative ethics under RSA 15-B, is repealed.

211:3 Effective Date.

I. Section 2 of this act shall take effect December 2, 2014.

II. The remainder of this act shall take effect upon its passage.
