AN ACT relative to time limits for regulatory boards and commissions to hold disciplinary proceedings.

ANALYSIS

This bill provides that occupational and professional regulatory boards will lose jurisdiction over a disciplinary matter when statutory time limits for holding hearings on disciplinary actions are not met.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to time limits for regulatory boards and commissions to hold disciplinary proceedings.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Regulatory Boards and Commissions; Time Limits for Hearings on Disciplinary Actions. Amend RSA 332-G by inserting after section 7 the following new section:

332-G:8 Time Limits for Hearings on Disciplinary Actions. All statutory time limits for the holding of hearings on disciplinary actions before any board or commission are jurisdictional, and no board or commission may hold a hearing on the disciplinary action after the expiration of the time limits set in the board or commission’s enabling statute unless the respondent in the disciplinary action has expressly waived the time limit.

2 Effective Date. This act shall take effect January 1, 2014.
