STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to titles for motor vehicles.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Certificate of Title; Exempted Vehicles. Amend RSA 261:3, I(k) to read as follows:

(k) Any motor vehicle [whose manufacturer's model year is older than 15 years] that was manufactured before January 1, 1999, except heavy trucks and truck-tractors whose gross vehicle weight exceeds 18,000 pounds.

2 Certificate of Title. Amend RSA 261:4-a to read as follows:

261:4-a Antique Motor Vehicle or Motor Vehicle Manufactured before January 1, 1999; Certificate of Title. Nothing in RSA 261:3 or RSA 261:4 shall prohibit the department from issuing a certificate of title for an antique motor vehicle or a motor vehicle manufactured before January 1, 1999 upon the request of the vehicle owner. The commissioner shall adopt rules, under RSA 541-A, relative to the issuance of a certificate of title for an antique motor vehicle or a motor vehicle manufactured before January 1, 1999.

3 Effective Date. This act shall take effect January 1, 2014.

HB 495-FN - FISCAL NOTE

AN ACT relative to titles for motor vehicles.

FISCAL IMPACT:

      The Department of Safety states this bill, as introduced, will increase state highway fund expenditures by $80,590 in FY 2014, $206,155 in FY 2015, $263,632 in FY 2016, and $272,605 in FY 2017; increase state highway fund revenues by $409,025 in FY 2014 and $818,050 in FY 2015 and each year thereafter; and increase local revenues by $49,083 in FY 2015 and $98,166 in FY 2016 and each year thereafter. There is no impact on county revenues, or county and local expenditures.

METHODOLOGY:

    The Department of Safety states this bill will limit the exemption to the certificate of title requirement for older vehicles to those manufactured before January 1, 1998. The Department estimates it will issue 32,722 additional titles annually as a result of this bill. At $25 per registration, the Department estimates additional revenue to the state of $409,025 per year in FY 2014 ($25 * 32,722 * 0.5, since the bill will be in effect for only half of FY 2014), and $818,050 each year thereafter ($25 * 32,722). The Department states it currently takes 25 employees to issue approximately 350,000 titles per year within ten business days. Based on this, the Department anticipates needing three additional full-time employees, beginning January 1, 2014, to process the additional titles resulting from the bill. The Department also anticipates additional costs resulting from increased current expenses, equipment, travel, and the need for additional title paper. In accordance with RSA 235:23, the Department will distribute 12 percent of the revenue increase to municipalities in the fiscal year following receipt of the revenue, resulting in additional revenue to municipalities of $49,083 in FY 2015 ($409,025 * 0.12) and $98,166 in FY 2016 and each year thereafter ($818,050 * 0.12). The Department estimates the bill’s fiscal impact on state revenues and expenditures as follows:
