STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT establishing a committee to study the overlap of federal, state, and local regulation relative to environmental issues.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Committee Established. There is established a committee to study the overlap of federal, state, and local regulation of environmental issues.
2 Membership and Compensation.
I. The members of the committee shall be as follows:
(a) Five members of the house of representatives, appointed by the speaker of the house of representatives.
(b) One member of the senate, appointed by the president of the senate.
II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.
3 Duties. The committee shall:
I. Review federal, state, and local environmental permitting and regulatory permit processes and programs common to development projects to determine whether these processes and programs contain duplicative regulation.
II. Study any such duplicative regulation to evaluate the value of additional environmental protection, if any, gained by the redundancy and the negative implications of such redundancies on state agency resources, town and city planning resources, the development community, and development projects.
III. Solicit information and testimony from individuals and entities with experience or expertise relevant to the study, including:
(a) The department of environmental services.
(b) The department of transportation.
(c) Members of the development community.
(d) Licensed civil engineers.
(e) Town and city planning directors.
(f) Other experts in environmental protection that the committee may deem appropriate to call.
IV. Determine whether any duplicated local and state environmental regulation is better suited for local or state authorities to review.
4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.
5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2013.
6 Effective Date. This act shall take effect upon its passage.
