AN ACT relative to the content of fiscal notes for bills.

ANALYSIS

This bill requires fiscal notes for bills and resolutions prepared by the legislative budget assistant to analyze costs and benefits to the citizens of the state, effect on businesses, and economic impacts or contributions of the policy, program, activity, or other event proposed in the bill.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the content of fiscal notes for bills.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraphs; Preparation of Fiscal Notes; Legislative Budget Assistant Amend RSA 14:46 by inserting after paragraph VI the following new paragraphs:

VII. The fiscal note prepared by the legislative budget assistant shall not be limited to dollar amounts, but shall include a discussion of the methodology used to reach any stated amounts. In addition, the fiscal note shall contain:

(a) A narrative stating the costs and benefits to the citizens of the state and to the political subdivisions of the bill.

(b) A conclusion as to the cost or benefit to the state general fund or any state special fund of the passage of the bill.

(c) An analysis of the general impact of the proposed bill upon any independently-owned businesses, including a description of the specific reporting and recordkeeping requirements upon small businesses which employ fewer than 10 employees.

(d) An analysis of the economic impact or contribution of the proposed bill, which shall examine the effect of the policy, program, activity, or other event proposed in the bill on the economy of a given area determined by the legislative budget assistant. The area may range from a local economy to state, national, or global. The economic impact or contribution shall be measured in terms of anticipated changes in economic growth by the output or value added as proposed by the bill and the associated changes in employment and wages, compared to what would otherwise be expected if the policy, program, activity, or other event did not occur.

VIII. All agencies are directed to cooperate with the legislative budget assistant in the preparation of fiscal notes. The legislative budget assistant may enter into a memorandum of understanding with appropriate state departments for the analysis required by subparagraph VII(d).

2 Effective Date. This act shall take effect 60 days after its passage.
