AN ACT relative to construction projects for the adjutant general’s department.

ANALYSIS

This bill establishes an exemption from the competitive bidding requirement for certain public works design and construction projects for the adjutant general’s department. The bill also inserts a requirement that the projects be subject to peer review by the department of administrative services.

This bill is a request of the adjutant general.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to construction projects for the adjutant general’s department.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Public Works Design and Construction; Major Projects; Adjutant General’s Department Added. Amend RSA 21-I:80, I(b) to read as follows:

(b) Projects for the department of fish and game, the adjutant general’s department, and the department of resources and economic development whose estimated total cost is not more than $250,000. Any such projects shall be subject to a peer review by the department, bureau of public works design and construction at the initial scoping of the project and at approximately 35 percent design (concept plans). Such projects may be done on a force account basis, by contracts awarded through competitive bidding, by short term rental of construction equipment, or by any combination of these methods. These departments are authorized to rent construction equipment for periods not exceeding 6 months at rates the departments deem competitive through the use of quotes or bids.

2 Effective Date. This act shall take effect 60 days after its passage.
