STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to legislative approval of collective bargaining agreements entered into by the state.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Bargaining by State Employees. Amend RSA 273-A:9 by inserting after paragraph I the following new paragraph:

I-a. Notwithstanding any other provision of law to the contrary, every collective bargaining agreement entered into by the state shall be approved by the fiscal committee of the general court before each takes effect.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 153-FN - FISCAL NOTE

AN ACT relative to legislative approval of collective bargaining agreements entered into by the state.

FISCAL IMPACT:

      The Department of Administrative Services and Judicial Branch state this bill, as introduced, may have an indeterminable impact on state expenditures in FY 2014 and each year thereafter. There will be no impact on state, county, or local revenue, or county and local expenditures.

METHODOLOGY:

    The Department of Administrative Services states this bill would require Fiscal Committee approval of all collective bargaining agreements with the state before they take effect. The Department states that while approval by the Fiscal Committee does not have a fiscal impact in and of itself, there may be an indeterminable fiscal impact associated with how long it takes for Fiscal Committee approval. For example, the Department states savings from a negotiated agreement could be lost while awaiting Legislative approval.

    The Judicial Branch states it currently negotiates collective bargaining agreements with its two unions and anticipates any expenditures would be incidental to preparation and presentation to the Fiscal Committee, which would be less than $10,000 annually.
