AN ACT relative to electronic prescriptions.

ANALYSIS

This bill declares that a prescription subject to the 48-hour exception process under RSA 420-J:7-b shall be considered approved and shall be filled if the exception process exceeds the 48-hour period.

This bill is the result of the committee established in 2011, 117 as amended by 2012, 109.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to electronic prescriptions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Pharmacists and Pharmacies; Prescriptions. Amend RSA 318:47-c, I by inserting after subparagraph (b) the following new subparagraph:

(c) A prescription that is written, oral, or electronically submitted that requires an exception for coverage shall be considered approved and shall be filled if the exception process exceeds 48 hours, as provided in RSA 420-J:7-b.

2 Effective Date. This act shall take effect 60 days after its passage.
