STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to fees for certain charitable gaming licenses.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Game Operator Licenses; Fees. Amend RSA 287-D:2-d, III to read as follows:

III. An applicant for a primary game operator license under RSA 287-D:2-c shall apply to the racing and charitable gaming commission, and if the applicant meets all other requirements of this chapter and pays the fee [established by the racing and charitable gaming commission in rules adopted pursuant to RSA 541-A] of $50,000, a license shall be issued. A primary game operator license issued under RSA 287-D:2-c shall expire on December 31 of the fifth year after its issue. The racing and charitable gaming commission shall notify the attorney general and police chief of any city or town where games of chance are held of any applications approved. RSA 7:28-c shall not apply to game operator licensees subject to this chapter. An applicant for a secondary game operator license under RSA 287-D:2-c shall apply to the racing and charitable gaming commission, and if the applicant meets all other requirements of this chapter and pays the fee established by the racing and charitable gaming commission in rules adopted pursuant to RSA 541-A, which shall not exceed $45, a license shall be issued. A secondary game operator license issued under RSA 284-D:2-c shall expire on the last day of the month of the licensee’s birthday.

2 Effective Date. This act shall take effect upon its passage.

HB 1127-FN FISCAL NOTE

AN ACT relative to fees for certain charitable gaming licenses.

FISCAL IMPACT:

    The Racing and Charitable Gaming Commission states this bill, as introduced, will increase state education trust fund revenue by $3,663,000 in FY 2015, and decrease state education trust fund revenue by $37,000 in FY 2016, and each year thereafter. There is no impact on county and local revenue, or state, county and local expenditures.

METHODOLOGY:

The Racing and Charitable Gaming Commission states this bill establishes a 5-year primary game operator license for a fee of $50,000. The primary game operator license fee, established in rule, is $500 each year. The Commission states there are 74 licensed primary game operators and the Commission assumes the same operators will pay the increased fee. Based on the assumption that the number of primary game operators will remain at 74, state education trust fund revenue will increase by $3,663,000 (($50,000 proposed license fee *74 primary operators) – ($500 current license fee * 74 primary operators)) in the first year and a decrease by $37,000 ($500 current license fee * 74 primary operators) for the next four years. The Commission states this bill will have no impact on state expenditures.
