STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT establishing a committee to study the solid waste operator training program and financial assurance for corrective action at solid waste landfills.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a house committee to study solid waste operator training and corrective action at solid waste landfills.

2 Membership and Compensation.

I. The members of the committee shall be 5 members of the house of representatives, 2 of whom shall be members of the environment and agriculture committee, and 2 of whom shall be members of the municipal and county government committee, appointed by the speaker of the house of representatives.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties. The committee shall study issues related to:

I. The solid waste operators training program established pursuant to RSA 149-M:6, including but not limited to:

(a) Funding sources.

(b) Training course providers.

(c) License fees.

(d) Uses for the revolving fund.

II. Financial assurance requirements relative to corrective action at solid waste facility landfills, including but not limited to:

(a) The need for financial assurance to guarantee corrective action costs.

(b) Options for providing financial assurance.

(c) Options for determining the amount needed.

(d) How other states address the issue and whether any of those programs are a good template for New Hampshire.

4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Three members of the committee shall constitute a quorum.

5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2014.

6 Effective Date. This act shall take effect upon its passage.
