AN ACT relative to an appeal of a change of school assignment decision by a superintendent.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to an appeal of a change of school assignment decision by a superintendent.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Change of School or Assignment; Appeal to School Board. Amend RSA 193:3, III(a) to read as follows:

(a) Each school board shall establish a change of school assignment policy, based on the best interest of the pupil, authorizing the superintendent to [re-assign] reassign a pupil from the public school to which he or she is currently assigned to another public school, which shall include a procedure for a pupil’s parent or legal guardian to appeal the superintendent’s reassignment decision to the school board, or to approve a request from another superintendent to accept a transfer of a pupil from a school district that is not part of the school administrative unit, provided that the following conditions are met:

2 Change of School or Assignment; Authority of School Board. Amend RSA 193:3, III(h) to read as follows:

(h) Notwithstanding RSA 21-N:11, III, for the purposes of this paragraph, the decision of the [superintendent] school board shall be final.

3 Effective Date. This act shall take effect 60 days after its passage.
