ANALYSIS

This bill defines “minor” and “child” as a person up to 21 years of age for purposes of the use of physical force in educational and child care settings. The bill also permits teachers to participate in special training courses, if offered by a school district.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to the use of force by persons with special responsibilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Physical Force by Persons With Special Responsibilities. Amend RSA?627:6, II by inserting after subparagraph (b) the following new subparagraph:

(c) In this paragraph, “minor” and “child” shall mean a person up to 21 years of age.

2 New Subdivision; Special Training Courses. Amend RSA 189 by inserting after section 64 the following new subdivision:

Special Training Courses

189:65 Special Training Courses. A teacher, administrator, or other school personnel may participate in special training courses, if offered by a school district, on the issues of appropriate and legal forms of restraining a student from injuring himself, herself, or others pursuant to RSA 627:6; protection of students from injury or death resulting from intruders in the school; school procedures for responding to and reporting threats to students and school personnel; and the psychology of the student-teacher relationship.

3 Effective Date. This act shall take effect 60 days after its passage.
