STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT allowing a claimant to take possession of his or her lost or stolen property under certain circumstances.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Return of Lost or Stolen Property. Amend RSA 407 by inserting after section 12-a the following new section:

407:12-b Return of Lost or Stolen Property. An insurer shall allow an insured person to take possession of his or her lost or stolen property if the property is recovered within 60 days from the date the disappearance or theft is reported to the insurance carrier; provided that the insured person returns the funds paid to him or her for the initial claim. In addition, the insurer shall not charge the insured person more than one percent interest per month on any returned funds.

2 Effective Date. This act shall take effect 60 days after its passage.
