This bill requires the higher education commission to approve private postsecondary career schools and other private entities doing business in this state to grant degrees provided the commission determines that the school’s or entity’s programs meet the commission’s criteria for approval of degree granting institutions of higher education.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT authorizing conferral of degrees by private entities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Higher Education Commission; Conferring Degree Granting Authority on Private Postsecondary Career Schools. Amend RSA 21-N:8-a, II by inserting after subparagraph (e) the following new subparagraph:

(f) In addition to its duties under subparagraph (e), the commission shall authorize a private postsecondary career school which is licensed under RSA 188-G, or any other private entity doing business in this state, to grant postsecondary degrees, provided the commission determines that the school’s or entity’s programs meet the commission’s criteria for approval of degree granting institutions of higher education.

2 Higher Education Corporations; Granting of Degrees. Amend RSA 292:8-h, I-III to read as follows:

I. This section shall apply to all educational institutions within the state granting degrees or seeking to do so, and all private postsecondary career schools licensed by the commission under RSA 188-G, except the following:

(a) Any institution now granting degrees which has been in continuous operation since before 1775;

(b) [Repealed.]

(c) Institutions of the university system of New Hampshire pursuant to RSA 187-A and institutions of the community college system of New Hampshire pursuant to RSA 188-F.

II. No educational institution shall grant degrees unless authorized by name to do so by an act of the legislature. A private postsecondary career school licensed by the commission under RSA 188-G, or other private entity doing business in this state, may grant degrees as provided in RSA 21-N:8-a, II(f).

III. The commission shall specify the degrees an institution or private postsecondary career school may grant, and the commission may renew, for a set term of years, degree granting authority. The commission shall report its activity by January 31 of each odd-numbered year to both the house and senate standing committees on education.

3 Effective Date. This act shall take effect 60 days after its passage.
