STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT defining “farm stand.”

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Definition of Farm Stand. Amend RSA 21:34-a by inserting after paragraph VI the following new paragraph:

VII. “Farm stand” shall mean an on-farm retail operation which only sells products produced on that farm including homestead products, eggs, cheese, and raw milk sold by a producer-distributor producing less than an average of 80 quarts of milk a day. A farm stand may be off site from the farm so long as the following conditions are met:

(a) The farmer has a contract with a person that includes a space where goods are sold and the presence of at least one person to oversee the farm stand.

(b) The farmer shall provide a certificate of liability for insurance to the person overseeing the farm stand.

(c) All products offered for sale at the off site farm stand shall be labeled individually or have a sign where the products are displayed which displays the name, address, and phone number of the farm of origin.

(d) At least 75 percent of the products offered for sale at the off site farm stand shall be grown or produced within a 50 mile radius of the off site farm stand.

2 Effective Date. This act shall take effect 60 days after its passage.
