STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fourteen
AN ACT relative to the definition of a controlled drug analog.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Controlled Drug Act; Definitions. Amend RSA 318-B:1, VI-a to read as follows:
VI-a. “Controlled drug analog” means a substance that has a chemical structure substantially similar to that of a controlled drug and [that was specifically designed to produce] which has an effect substantially similar to that of a controlled drug. The term shall not include a drug manufactured or distributed in conformance with the provisions of an approved new drug application or an exemption for investigational use within the meaning of section 505 of the Federal Food, Drug and Cosmetic Act, 52 Stat. 1052 (21 U.S.C. 355).
2 Effective Date. This act shall take effect 60 days after its passage.
