AN ACT revising the child support guidelines.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT revising the child support guidelines.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Statement of Findings. The general court finds that:

I. The 2004 Commission to Study Child Support and Related Child Custody Issues recommended that New Hampshire adopt a cost-based model in determining child support obligations.

II. The revisions to the child support formula in this act are based on the recommendations of the commission and establish a formula more closely tied to the basic cost of raising a child in New?Hampshire.

2 Definition of Total Support Obligation. Amend RSA 458-C:2, XI to read as follows:

XI. “Total support obligation” means either net income multiplied by the appropriate percentage derived from RSA 458-C:3 or $600 per month, per child, whichever is less.

3 Child Support Formula; $600 Maximum. RSA 458-C:3, II(a) is repealed and reenacted to read as follows:

(a) The total support obligation shall be equal to $600 per month per child, taking into account the age and special needs of each child for whom support is being calculated, or the parents’ total net income, as defined in RSA 458-C:2, VI, multiplied by the appropriate percentage derived from paragraph I, whichever is less.

4 Effective Date. This act shall take effect 60 days after its passage.
