STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT making spoofing an unfair and deceptive act under the consumer protection law.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Regulation of Business Practices for Consumer Protection; Acts Unlawful; Spoofing. Amend RSA 358-A:2 by inserting after paragraph XVI the following new paragraph:

XVII. Transmitting misleading or inaccurate caller identification information, a practice known as “spoofing,” with the intent to defraud, cause harm, or wrongfully obtain anything of value.

2 Effective Date. This act shall take effect January 1, 2016.

SB 218-FN - FISCAL NOTE

AN ACT making spoofing an unfair and deceptive act under the consumer protection law.

FISCAL IMPACT:

      The Department of Justice states this bill, as introduced, will have an indeterminable impact on state expenditures in FY 2016 and each year thereafter. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Department of Justice states this bill adds a new section to the Consumer Protection Act, RSA 358-A, prohibiting a practice commonly known as “spoofing,” which includes, among other acts, transmitting to the consumer misleading or inaccurate caller identification information. The Department states this bill could necessitate additional investigative resources although prosecution of the offenders could be accomplished with existing resources. Therefore, the Department states this bill will have an indeterminable impact of state expenditures.
