STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT appropriating funds to the department of environmental services for the purpose of restoring and protecting waters of the southeast watershed in accordance with EPA guidelines.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Department of Environmental Services. Southeast Watershed Alliance; Appropriation.

I. The sum of $200,000 for the fiscal year 2016 and the sum of $200,000 for the fiscal year 2017, are hereby appropriated to the department of environmental services to develop a plan to restore and protect the waters of the southeast watershed in accordance with Environmental Protection Agency guidelines. The governor is authorized to draw a warrant for said sums out of any money in the treasury not otherwise appropriated.

II. The department, with the consent of the governor and council, shall pay the moneys in paragraph I to the southeast watershed alliance contingent upon the municipalities located in the watershed raising the equal matching amount.

2 Southeast Watershed Alliance; Management and Restoration Plan. The plan developed under section 2 of this act shall incorporate an analysis of water, wastewater, storm water, septic, fertilizers and shall include:

I. Measures to improve and protect water quality and meet clean water standards, particularly with respect to nutrient pollution.

II. Guidance for watershed municipalities, the state, and other stakeholders, individually and in collaboration with one another, to plan, implement, and invest in water, wastewater, stormwater, and land use planning and management approaches that protect the water quality, natural hydrology, and habitats of the state’s resources and that advance the state’s economic growth, resource protection, and planning policy under RSA 9-B.

III. Proposed solutions to reduce pollution and enhance water quality within the southeast watershed.

3 Report. The department shall submit a report to the speaker of the house, the president of the senate, and the governor on or before November 1, 2016.

4 Effective Date. This act shall take effect July 1, 2015.

SB 229-FN-A FISCAL NOTE

AN ACT appropriating funds to the department of environmental services for the purpose of restoring and protecting waters of the southeast watershed in accordance with EPA guidelines.

FISCAL IMPACT:

    The Department of Environmental Services states this bill, as amended by the Senate (Amendment #2015-0103s), will increase state general fund expenditures and local revenue by $200,000 in FY 2016, and $200,000 in FY 2017, and increase local expenditures by $400,000 in FY 2016, and $400,000 in FY 2017. There will be no fiscal impact on state and county revenue, or county expenditures.

    This bill appropriates $200,000 in FY 2016, and $200,000 in FY 2017 from the state general fund to the Department of Environmental Services for the purpose of this act.

METHODOLOGY:

    The Department of Environmental Services states this bill appropriates $200,000 in FY 2016 and $200,000 in FY 2017 to the Department to be paid to the southeast watershed alliance for the purpose of developing a plan to restore and protect the waters of the southeast watershed in accordance with environmental protection agency guidelines. The Department assumes the communities in the southeast watershed alliance will provide $200,000 each year to match the amount appropriated to the Department.
