STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to licensure of guides by the fish and game department.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Fish and Game; Licensure of Guides.  Amend RSA 215:2 to read as follows:

\t215:2  Application for License; Issue.  Application for a license shall be made to the executive director, or to some person designated by [him] the executive director. The executive director shall prescribe rules and regulations under which such licenses shall be issued. An applicant for any guide license shall not be issued a license if he or she has been convicted of an offense while fishing, hunting, or trapping during the period preceding the date of application in any jurisdiction as follows:  for violations - 2 years; for misdemeanors - 5 years; and for felonies - 7 years.

\t 2  Fish and Game; Guides; Cancellation of License.  Amend RSA 215:2 to read as follows:

\t215:3  Cancellation of License.  Any licensed guide who [violates any provision of this title, or who violates any rule or regulation promulgated by the executive director, or who] makes any false statement in his or her application for a license, or who [otherwise, in the judgment of the executive director,] is deemed unsuitable by the executive director and by a local or state law enforcement officer to act as a guide, shall immediately forfeit and surrender his or her license.

\t3  New Section; Fish and Game; Guides; Revocation of License.  Amend RSA 215 by inserting after section 3 the following new section:

\t215:3-a  Revocation of License.  Any licensed guide who commits a fishing, hunting, or trapping violation as a first offense shall be subject to a 90-day suspension by the executive director.  A second fishing, hunting, or trapping violation in a 10-year period shall result in a 2-year revocation of a license, and the guide shall be required to reapply for licensure and to meet all requirements in rules of the department before being issued a guide's license.  A licensed  guide convicted of a misdemeanor while fishing, hunting, or trapping shall result in a 5-year suspension by the executive director of a guide's license.  No licensed guide convicted of a felony while fishing, hunting, or trapping shall be issued a hunting guide license by the department.

\t4  Effective Date.  This act shall take effect 60 days after its passage.
