\tThis bill removes the requirement that a physician be appointed to the occupational therapy governing board.  The bill also clarifies the regulation of equipment used in respiratory care practice.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to the membership of the occupational therapy governing board and relative to equipment used in respiratory care practice.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Allied Health Professionals; Occupational Therapy Governing Board; Physician.  Amend RSA 328-F:4, V to read as follows:

\t\tV.  The occupational therapy governing board shall consist of [2] 3 licensed occupational therapists and one occupational therapy assistant, who have actively engaged in the practice of occupational therapy in this state for at least 3 years, [one physician knowledgeable in the practice of occupational therapy,] and one public member.

\t2  Allied Health Professionals;  Respiratory Care Practice; Equipment.  Amend RSA 326-E:9 to read as follows:

\t326-E:9  Materiel Management.  The assembly, delivery, maintenance, repair, and testing of respiratory care equipment and supplies shall be performed by respiratory care practitioners and other personnel in conformity with rules adopted by the board under RSA 541-A.  Respiratory care equipment may be delivered to a recipient by any individual or company, provided the individual delivering the respiratory care equipment leaves the equipment at the point of delivery and does not set up the equipment or provide calibration or instruction.

\t3  Effective Date.  This act shall take effect 60 days after its passage.
