STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to enforcement of the prohibition on the use of mobile electronic devices while driving.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Paragraph; Use of Mobile Electronic Devices While Driving.  Amend RSA 265:79-c by inserting after paragraph IV the following new paragraph:

\t\tV.  Enforcement of this section by law enforcement agencies shall be accomplished only when a law enforcement officer sees the driver of a motor vehicle with a device against his or her ear or holding a device in his or her hand and operating the device.

\t2  Effective Date.  This act shall take effect January 1, 2017.
