STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to licensing spas and salons to serve alcoholic beverages.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Paragraph; Definitions; Spa/Salon.  Amend RSA 175:1 by inserting after paragraph LXIII the following new paragraph:

\t\tLXIII-a.  "Spa/salon" means any commercial establishment that offers to the public massage therapy performed by persons licensed in accordance with RSA 328-B, or  barbering, cosmetology, esthetics, or manicure services performed by persons licensed in accordance with RSA 313-A.

\t2  New Section; Spa/Salon License.  Amend RSA 178 by inserting after section 20-a the following new section:

\t178:20-b  Spa/Salon License.

\t\tI.  The commission may issue a spa/salon license in any town which has voted to accept the provisions of RSA 663:5, I(b) and (c).  The license shall entitle the licensee to:

\t\t\t(a)  Permit the consumption of lawfully acquired beverage or wine on the premises of the licensee by any customer of the spa/salon.

\t\t\t(b)  Serve beverages and wines by the glass, or other suitable container for consumption on the premises by any customer of the spa/salon.

\t\tII.  The licensee shall not allow any customer to consume more than 2 5-ounce glasses of wine or one 12-ounce glass of beer, nor shall it sell or otherwise charge a fee to such customer for the wine or beer served or consumed.  The privileges of this license shall be limited to the premises of the spa/salon regularly occupied and used as such.

\t3  Fees.  Amend RSA 178:29, I to read as follows:

1160-FN - FISCAL NOTE

 

AN ACT\trelative to licensing spas and salons to serve alcoholic beverages.

 

 

FISCAL IMPACT:

The New Hampshire Liquor Commission states this bill, as introduced, will increase state revenue and expenditures by an indeterminable amount in FY 2017 and in each year thereafter.  There will be no fiscal impact on county or local expenditures or revenue.

 

METHODOLOGY:

The Liquor Commission states it has no information on how many spas and salons might apply for a license to serve alcoholic beverages and therefore cannot estimate the impact on revenue or expenditures.
