STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trepealing licensure of showmen.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

 

\t1  Repeal.  RSA 286:1, relative to showmen, is repealed.

\t2  Shows and Open Air Meetings; Penalty  Amend RSA 286:5 to read as follows:

\t286:5  Penalty.  Whoever violates the provisions of RSA 286:[1]2-4 shall be guilty of a misdemeanor if a natural person, or guilty of a felony if any other person.  It shall be the duty of the selectmen to prosecute for every violation of this chapter.

\t3  Effective Date.  This act shall take effect 60 days after its passage.

1187-FN-LOCAL - FISCAL NOTE

 

AN ACT\trepealing licensure of showmen.

 

 

FISCAL IMPACT:

The New Hampshire Municipal Association states this bill, as introduced, may decrease local revenue by an indeterminable amount in FY 2016 and each year thereafter.  There will be no fiscal impact to state, county, and local expenditures or state and county revenue.

 

METHODOLOGY:

The New Hampshire Municipal Association states this bill repeals RSA 286:1, which requires showmen, tumblers, rope dancers, ventriloquists, and others to obtain a license from the selectmen before performing publicly in a municipality.  The Association states this bill may result in a loss of license fee revenue to municipalities which may charge up to $300 per day under current law.  The Association does not have information available to estimate the potential fiscal impact of this bill.

 

The Judicial Branch states that between FY 2006 and FY 2015 there were no prosecutions under RSA 286 in either circuit or superior courts.  The Judicial Branch concludes, based on the aforementioned history, this bill will have no fiscal impact on its operations.
