ANALYSIS
\tThis bill amends an 1883 act entitled "An act to Aid Dartmouth College in Furnishing Tuition for Indigent Students From New Hampshire" as follows:
\tI. Requires the Dartmouth college trustees to submit a copy of the annual account of the fund to assist indigent students to the governor with copies to the speaker of the house of representatives, senate president, chairpersons of the house and senate education committees, commissioner of the department of education, and the director of the division of charitable trusts, and to append a copy to the Dartmouth college annual report.
\tII. Imposes a $10,000 fine against Dartmouth college for failing to timely file the annual account.
\tIII. Permits women to apply for tuition assistance from the fund.
\tIV. Establishes a fund in the department of education, division of higher education, to provide tuition scholarships for postsecondary education for indigent students from New Hampshire.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT\trelative to aid granted to Dartmouth College to assist indigent students from New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
\t1 Aid to Dartmouth College in Furnishing Tuition for Indigent Students From New Hampshire. Amend 1883; 116:2 and 116:3 to read as follows:
\tSect. 2. Said sums when paid shall he at once securely invested, and shall: constitute a fund, the income whereof shall be forever used in paying the tuition at said co11ege of indigent students whose domicile at the time of entering college was within this state. And said trustees shall keep a true account of all money so received and paid out, and transmit annually no later than June 30, a copy of the same, to [his Excellency] the governor of the state, and the governor shall cause a reasonable number of said copies to be printed and distributed to the speaker of the house of representatives, the senate president, the chairpersons of the house and senate education committees, the commissioner of the department of education, the director of the division of charitable trusts in the department of justice, and to the members of the legislature at each biennial session, The trustees shall append a copy of the annual account to the Dartmouth college annual report. The college shall be fined $10,000 for each year in which the trustees fail to complete or timely file the annual account required in this section. The fine amount shall be remitted to the fund established in RSA 21-N:8-c.
\tSect. 3. Any young man or woman applying therefor to the president or a trustee of the college, shall be entitled to have his or her tuition paid in whole or in part from the income of the aforesaid fund, provided he or she possesses the following qualifications and answers the following conditions, namely:
\t\t1. Pecuniary inability to pay the expenses of a college course.
\t\t2. Legal domicile within this state at the time of making the application.
\t\t3. The qualification as to scholarship required for admission to college and continuance therein.
\t\t4. Good moral character, good mental endowment, and a suitable desire to benefit himself or herself and the community by securing a good education.
\tAnd the foregoing facts shall be carefully inquired into in such way as the trustees may direct, and a certificate thereof filed with the records of the trustees before any such applicant shall be admitted to share in the benefits of said fund. But no greater sum shall ever be paid for the tuition of any such person than the established rate of tuition for other students.
\t2 Higher Education Commission; Duties. Amend RSA 21-N:8-a, II(e)(10) to read as follows:
\t\t\t\t(10) Administer the indigent student assistance fund established in RSA 21-N:8-c in accordance with the provisions of RSA 21-N:8-c and 1883; 116, "An act to Aid Dartmouth College in Furnishing Tuition for Indigent Students From New Hampshire."
\t\t\t\t(11) Assume other responsibilities as may be provided in state or federal law.
\t3 New Section; Aid to Dartmouth College in Furnishing Tuition for Indigent Students From New Hampshire; Fund Established. Amend RSA 21-N by inserting after section 8-b the following new section:
\t21-N:8-c Indigent Student Assistance Fund. There is established in the office of the state treasurer a nonlapsing fund to be known as the indigent student assistance fund to be administered by the department of education, director of the division of higher education, which shall be kept distinct and separate from all other funds. All moneys derived from fine amounts collected pursuant to 1883; 116, "An act to Aid Dartmouth College in Furnishing Tuition for Indigent Students From New Hampshire" shall be deposited into the fund. All moneys in the fund shall be continually appropriated to the director of the division of higher education for the purpose of providing tuition scholarships for postsecondary education for indigent student from New Hampshire.
\t4 New Subparagraph; Application of Receipts; Indigent Student Assistance Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (331) the following new subparagraph:
\t\t\t\t(332) Any moneys deposited in the indigent student assistance fund established in RSA 21-N:8-c.
\t5 Effective Date. This act shall take effect 60 days after its passage.

1189-FN - FISCAL NOTE
AN ACT\trelative to aid granted to Dartmouth College to assist indigent students from New Hampshire.
FISCAL IMPACT:
The Office of Legislative Budget Assistant states this bill, as introduced, may increase state restricted revenues and expenditures by an indeterminable amount in FY 2017 and each year thereafter. There will be no impact on county and local revenues or expenditures.
METHODOLOGY:
This bill requires Dartmouth College to file an annual accounting of the fund to assist indigent students to the Governor, various members of the General Court, and certain agency officials no later than June 30 of each year and implements a $10,000 fine for failure to do so timely. This bill also establishes the indigent student assistance fund, to be administered by the Higher Education Commission within the Department of Education, to which the penalty revenue, if any, would be credited to and be used for the purpose of providing tuition scholarships for postsecondary education for indigent students from New Hampshire. It is indeterminable how much revenue, if any, may be credited to or disbursed from this fund in FY 2017 and each year thereafter.
