STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to conservation number plate funds.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t61:1  Reference Change.  Amend RSA 6:12, I(b)(60) to read as follows:

\t\t\t\t(60)  The designated portion of moneys received under RSA 261:97-a, which shall be credited to the conservation number plate [trust] fund established in RSA 261:97-b.

\t61:2  Administrative Fund.  Amend RSA 227-M:7-a, I to read as follows:

\t\tI.  There is established in the office of the [state treasurer] New Hampshire land and community heritage investment authority a fund to be known as the land and community heritage investment program administrative fund into which the [state treasurer] commissioner of safety shall credit any revenue generated pursuant to RSA 261:97-b, I-a.  There shall also be deposited, on a monthly basis, interest income generated on appropriations made to the land and community heritage investment program trust fund pursuant to RSA 227-M:7.  The total revenues generated to the administrative fund from these 2 sources shall not exceed $335,000 for each fiscal year.  Any revenue generated from these 2 sources in excess of the $335,000 maximum per year shall be credited by the [treasurer] New Hampshire land and community heritage investment authority to the land and community heritage investment program trust fund in RSA 227-M:7.  The authority shall include in its annual report the amount of revenues exceeding the maximum which are credited to the trust fund.

\t61:4  Conservation Number Plate Fund.  Amend RSA 261:97-b to read as follows:

\t261:97-b  Conservation Number Plate [Trust] Fund.

\t\tI.  There is hereby established a conservation number plate [trust] fund under the administration of the [state treasurer] commissioner of safety.  The fund shall be used for the promotion, protection, and investment in the state's natural, cultural, and historic resources.  The fund shall be nonlapsing.  The [state treasurer] commissioner of safety shall distribute the funds annually on [July] August 1, except as provided in paragraph I-a, as follows: $5,000 of every $100,000 received, up to a total of $50,000, shall be distributed to the department of transportation for the expanded wild flower establishment program for use in planting lilacs and native wild flowers; $1 for every new, renewal, and transfer of registration, up to a total of $50,000, shall be placed in a nonlapsing account for use by the department of resources and economic development to promote the conservation number plate program; the remainder shall be distributed equally among the department of cultural resources, the department of fish and game, the department of resources and economic development, the state conservation committee, and the New Hampshire land and community heritage investment authority.

\t\tI-a.  The [state treasurer] commissioner of safety shall distribute the share of funds due the New Hampshire land and community heritage investment authority, pursuant to RSA 261:97-b, I, on the first day of each month.  The total amount shall not exceed $200,000 per fiscal year.

\t\tII.  Each department and commission receiving funding from the conservation number plate [trust] fund shall establish a line item in their budget.  Moneys received from the conservation number plate [trust] fund shall be in addition to any other sums appropriated and shall not replace base funding received by any of these departments or commissions through the budget process.

\t61:5  Reference Changed.  Amend RSA 261:97-c, VII to read as follows:

\t\tVII.  Any funds transferred from the conservation number plate [trust] fund which remain unexpended at the end of the fiscal year shall be nonlapsing.

\t61:6  Reference Changed.  Amend RSA 261:97-f, II(a)(4) to read as follows:

\t\t\t\t(4)  The amount paid to the state treasurer for deposit into the New Hampshire conservation number plate [trust] fund during the preceding fiscal year.

\t61:7  Effective Date.  This act shall take effect 60 days after its passage.
