STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to develop a structure for the implementation of an alternative contract for health care payments.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Commission to Develop a Structure for the Implementation of an alternative Contract for Health Care Payments.  Amend RSA 400-A by inserting after section 67 the following new subdivision:

Commission to Develop a Structure for the Implementation of an Alternative Contract for

Health Care Payments

\t400-A:68  Commission Established.

\t\tI.  There is established a commission to develop a structure for the implementation of an alternative contract for health care payments.

\t\t\t(a)  The members of the commission shall be as follows:

\t\t\t\t(1)  Three members of the house of representatives, 2 of whom shall be members of the house commerce and consumer affairs committee and one of whom shall be a member of the house health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

\t\t\t\t(2)  One  member of the senate, appointed by the president of the senate.

\t\t\t\t(3)  The insurance commissioner, or designee.

\t\t\t\t(4)  A representative from a licensed health insurance provider, appointed by the governor.

\t\t\t\t(5)  A representative from the New Hampshire Hospital Association, appointed by the association.

\t\t\t\t(6)  A representative from the New Hampshire Medical Society, appointed by the society.

\t\t\t(b)  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tII.  The commission's study shall include, but not be limited to, studying the proposal submitted by the insurance department for a structure for implementing an alternative contract which contains alternative payment methodologies for health care payments, including specific recommendations on health care delivery and quality.  The commission shall develop an implementation plan for the alternative contract.  The commission shall also develop a proposal under which providers which would be required, over time, to shift to the alternative contract.  The commission may review any other matter the commission deems relevant to its objective.  

\t\tIII.  The members of the  commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Five members of the commission shall constitute a quorum.

\t\tIV.  The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library when the commission has completed its study.

\t2  Repeal.  RSA 400-A:68, relative to a commission to develop a structure for the implementation of an alternative contract for heath care payments, is repealed.

\t3  Contingency.  Section 2 of this act shall take effect on the completion date of the commission established in RSA 460-A:68 as inserted by section 1 of this act, as certified by the insurance commissioner to the secretary of state and the director of legislative services.

\t4  Effective Date.

\t\tI.  Section  2 of this act shall take effect as provided in section 3 of this act.

\t\tII.  The remainder of this act shall take effect upon its passage.
