STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study the collection of child abuse data.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Child Protection Act; Commission to Study the Collection of Child Abuse Data Established.  Amend RSA 169-C by inserting after section 38-a the following new section.

\t169-C:38-b  Commission to Study the Collection of Child Abuse Data Established.  There is established a commission to study the collection of child abuse data.

\t\tI.  The members of the commission shall be as follows:

\t\t\t(a)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t(b)  Two members of the senate, appointed by the president of the senate.

\t\t\t(c)  The commissioner of the department of health and human services, or designee.

\t\t\t(d)  The director of the division for children, youth and families, or designee.

\t\t\t(e)  The director of the division of public health services, or designee.

\t\t\t(f)  The commissioner of the department of safety, or designee.

\t\t\t(g)  A representative of the Crimes Against Children Research Center at the university of New Hampshire, appointed by the center.

\t\t\t(h)  The executive director of the New Hampshire Children's Trust, or designee.

\t\t\t(i)  The executive director of Granite Sate Children's Alliance, or designee.

\t\t\t(j)  One chief of police, appointed by the New Hampshire Association of Chiefs of Police.

\t\t\t(k)  A representative of the New Hampshire Hospital Association, appointed by the association.

\t\t\t(l)  One circuit court judge, family division, appointed by the chief justice of the circuit court.

\t\tII.  Legislative members shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIII.  The commission shall study the collection of child abuse data by the state of New Hampshire.  The study shall include:

\t\t\t(a)  Identification of all potential sources of child abuse and neglect data.

\t\t\t(b)  Recommendation of a comprehensive system for coordinated reporting to a central source.

\t\t\t(c)  Review of current law and practice regarding child abuse reporting requirements, including RSA 169-C:29 through RSA 169-C:39, and the 2008 edition of the child abuse protocol promulgated by the attorney general's task force on child abuse and neglect.

\t\tIV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Five members of the commission shall constitute a quorum.

\t\tV.  The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2016.

\t2  Repeal.  RSA 169-C:38-b, relative to the commission to study the collection of child abuse data, is repealed.

\t 3  Effective Date.

\t\tI.  Section 2 of this act shall take effect November 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage.
