STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study cryptocurrency regulation.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t205:1  New Subdivision; Commission to Study Cryptocurrency Regulation.  Amend RSA 399-G by inserting after section 24 the following new subdivision:

Commission to Study Cryptocurrency Regulation

\t399-G:25  Commission to Study Cryptocurrency Established.

\t\tI.  There is established a commission to study cryptocurrency regulation.

\t\tII.  The members of the commission shall be as follows:

\t\t\t(a)  Three members of the house of representatives, appointed as follows:  one member appointed by the speaker of the house of representatives, one member from the commerce and consumer affairs committee appointed by the chairperson of the commerce and consumer affairs committee, and one member of the ways and means committee, appointed by the chairperson of the ways and means committee.

\t\t\t(b)  The banking commissioner, or designee.

\t\t\t(c)  The director of the bureau of securities regulation, or designee.

\t\t\t(d)  One representative of the cryptocurrency industry, appointed by the governor.

\t\tIII.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIV.  The commission shall study whether regulation of the cryptocurrency industry is necessary in New Hampshire.

\t\tV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Four members of the commission shall constitute a quorum.

\t\tVI.  The commission shall annually report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1.

\t205:2  Repeal.  RSA 399-G:25, relative to the commission to study cryptocurrency regulation, is repealed.

\t205:3  Effective Date.

\t\tI.  Section 2 of this act shall take effect November 1, 2021

\t\tII.  The remainder of this act shall take effect upon its passage.
