STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Fifteen

 

AN ACT\trelative to cash dispensing machine requirements.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Notice; Cash Dispensing Machines.  Amend RSA 399-F:3, I(b) to read as follows:

\t\t\t(b)  Fee of $50 payable to the state of New Hampshire [in certified funds].

\t2  Notice; Cash Dispensing Machines.  Amend RSA 399-F:3, II to read as follows:

\t\tII.  Commencing in the calendar year following an operator’s compliance with paragraph I, the operator shall provide annually before July 1 to the commissioner a notice and fee in accordance with the provisions of [subparagraphs] subparagraph I(a) [and I(b)] and a renewal fee of $5 payable to the state of New Hampshire.

\t3  Notice; Cash Dispensing Machines.  Amend RSA 399-F:3, V to read as follows:

\t\tV.  The operator of a cash dispensing machine who fails to completely and accurately abide by this section shall not legally establish or operate such cash dispensing machine until [section] paragraph I is fully complied with, except that a fee of $100, [rather than $50,] shall be paid.

\t4  Repeal.  RSA 399-F:5, II, relative to fees collected for the operation of cash dispensing machines, is repealed.

\t5  Effective Date.  This act shall take effect 60 days after its passage.

HB 601-FN - FISCAL NOTE

 

AN ACT\trelative to cash dispensing machine requirements.

 

 

FISCAL IMPACT:

The Banking Department states this bill, as introduced, will decrease state revenue by $61,300 in FY 2016 and each year thereafter.  There is no fiscal impact on county and local revenue, or state, county and local expenditures.

 

METHODOLOGY:

The Banking Department states this bill removes the requirement that an operator of a cash dispensing machine annually provide notice and specific information regarding the machine to the Department.  This bill also repeals the requirement to pay a fee for each notice of a cash dispensing machine.  The Department states it has notice of 1,226 cash dispensing machines which will result in a revenue decrease of approximately $61,300 (1,226 machines * $50 fee) in each fiscal year.
