ANALYSIS

 

\tThis bill requires DNA analysis for any person found not guilty by reason of insanity or civilly committed to the department of corrections for the commission of any sexual offense, offense against a child, or other felony offense established under state or federal law.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to required DNA analysis for certain offenses.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  DNA Analysis Required.  Amend RSA 651-C:2, I to read as follows:

\t\tI.  Upon intake or prior to the release of any offender after conviction for the commission of any sexual offense, as defined in RSA 651-B:1, V, or any offense against a child as defined in RSA 651-B:1, VII, or any other felony offense prohibited by the laws of this or another state or federal law, whether on probation, conditional or unconditional release, completion of sentence, or release for any other reason, or any person declared not guilty by reason of insanity or civilly committed to the department of corrections, such person shall have a DNA sample taken for DNA analysis to determine identification characteristics specific to the person.

\t2  Effective Date.  This act shall take effect January 1, 2017.
