STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trequiring public schools to include drug and alcohol education as part of their health education curriculum.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; School Boards; Drug and Alcohol Education.  Amend RSA 189 by inserting after section 11-c the following new section:

\t189:11-d  Drug and Alcohol Education.

\t\tI.  Each public school in the state, as part of the school board-approved kindergarten through grade 12 health education program, shall provide age and developmentally appropriate drug and alcohol education to pupils based upon the needs of the pupils and the community.  The school board may authorize the use of an evidence-based prevention program.

\t\tII.  School boards shall develop policies authorizing school district personnel to provide pupils, parents, and legal guardians with information and resources relative to existing drug and alcohol counseling and treatment for pupils.  Nothing in this section shall require a school district to add additional programs or services, but only to provide information about available programs and services.

\t2 Effective Date.  This act shall take effect 60 days after its passage.

SB 369-FN - FISCAL NOTE

 

AN ACT\tencouraging public schools to include drug and alcohol education as part of their health education curriculum.

 

FISCAL IMPACT:

The Department of Education states this bill, as amended by the House (Amendment #2016-0082h), will have no impact on state, county, and local revenues or expenditures.

 

METHODOLOGY:

The Department of Education states current State Board of Education minimum standards for public school approval in administrative rules (Ed 306.40) already requires a kindergarten through grade 12 curriculum in health education designed to teach skills in the area of alcohol and other drug use prevention.  For this reason and that the bill does not require a district to add additional programs or services relative to information on counseling and treatment, the Department states this bill will have no fiscal impact.
