ANALYSIS

 

\tThis bill prohibits the feeding of wild deer at certain times and locations determined by the fish and game department and requires the labeling of wild animal feed.  The bill requires the fish and game department to distribute informational materials.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to the feeding of wild deer.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Fish and Game; Feeding of Wild Deer.  Amend RSA 208 by inserting after section 8-a the following new section:

\t208:8-b  Feeding of Wild Deer.  

\t\tI.  No person shall knowingly place food for consumption by wild deer at any time or in any location where the fish and game department has determined such feeding would be detrimental to the health of the deer population, or where such feeding results in a public health or safety risk.

\t\tII.  No person shall knowingly sell or offer to sell in this state feed for wild deer that is not conspicuously labeled "Feeding wild deer could be harmful or fatal to their health."

\t\tIII.  The fish and game department shall provide informational materials concerning the harmful or fatal feeding of wild deer to businesses and establishments in this state which sell or offer for sale wild animal feed.  Any such business or establishment shall provide the informational materials to persons purchasing wild animal feed.

\t\tIV.  Any person who violates the provisions of this section shall be guilty of a violation.

\t\tV.  This section shall not apply to baiting permitted under RSA 207:3-d.

\t2  Effective Date.  This act shall take effect 60 days after its passage.
