STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trequiring law enforcement agencies to file crime reports with the department of safety.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Uniform Crime Reporting System.  Amend RSA 106-B by inserting after section 14-b the following new section:

\t106-B:14-c  Uniform Crime Reporting System.

\t\tI.  Law enforcement agencies operating within New Hampshire shall submit crime reports to the department of safety, division of state police, based on the specifications prescribed by the Federal Bureau of Investigation’s (FBI’s) Criminal Justice Information Services’ (CJIS) Uniform Crime Reporting (UCR) Program.  The report shall be a compilation of the number of offenses and arrests on crimes occurring within their own jurisdictions, submitted in the manner and in the form specified by the FBI’s National Incident Based Reporting System (NIBRS).  Annual statistical reports shall be made available no later than July 1 of the following year, containing the number and nature of criminal offenses, arrests and clearances, and any other data determined to be appropriate relating to the method, frequency, cause, and prevention of crime.

\t\tII.  A law enforcement agency having no records management system with NIBRS reporting capabilities shall be provided the means to report by the division of state police.

\t2  Effective Date.  This act shall take effect 60 days after its passage.

SB 475-FN- FISCAL NOTE

 

AN ACT\trequiring law enforcement agencies to file crime reports with the department of safety.

 

 

FISCAL IMPACT:

The Department of Safety, Fish and Game Department, New Hampshire Association of Counties, and New Hampshire Municipal Association state this bill, as introduced, may increase state, county, and local expenditures in FY 2017 and each year thereafter.  There will be no impact on state, county, and local revenues.

 

METHODOLOGY:

The Department of Safety states this bill requires all law enforcement agencies in the state to file crime reports with the Division of State Police based on the Federal Bureau of Investigation’s uniform crime reporting program.  The Department states the majority of NH law enforcement agencies already comply with this reporting requirement and the remaining agencies (six county departments and nine local departments) may incur an increase in expenditures to comply with this bill’s provisions.  The Department states this bill will have no impact on its expenditures.

 

The Fish and Game Department states it may incur additional expenses related to personnel time in order to comply with the requirements of this bill.

 

The New Hampshire Association of Counties states this bill will increase county expenditures by an indeterminable amount in FY 2017 and each year thereafter.

 

The New Hampshire Municipal Association states this bill will increase local expenditures by an indeterminable amount in FY 2017 and each year thereafter.
