ANALYSIS

 

\tThis bill establishes an OHRV registration fee for persons who are members of OHRV which is reduced $30 from the increased fee paid by other registrants.  The fee provisions take effect upon certification by the executive director of fish and game of the implementation of certain requirements.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to an OHRV registration fee for persons who are members of an OHRV club.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  OHRV Registration; 14-Month Registration; Club Membership.  Amend RSA 215-A:21, X to read as follows:

\t\tX.  The executive director shall issue to a person applying therefor a 14-month registration to include the months of May and June for a registration of an OHRV under RSA 215-A:23, provided that the prorated registration fee and the appropriation from each fee shall be as follows:

\t\t\t(a)  For an individual resident registration- [$49] $79 for each 2-wheeled trail bike registration or [$60] $90 for each other OHRV registration upon presentation of a valid driver's license issued to a New Hampshire resident 18 years of age or older.  An individual resident registering a 2-wheeled trail bike or OHRV who provides proof, at the time of registration, that the individual is a member of an organized New Hampshire nonprofit OHRV club which is a member of the New Hampshire Off Highway Vehicle Association, shall pay $49 for each 2-wheeled trail bike registration or $60 for each other OHRV registration.

\t\t\t\t(1)  The first [$8.16] $38.16 of each 2-wheeled trail bike registration or [$19.16] $49.16 of each other OHRV registration registered by an individual who does not, at the time of registration, provide proof of membership in an organized New Hampshire nonprofit OHRV club, or $8.16 of each 2-wheeled trail bike or $19.16 of each other OHRV registration registered by an individual who provides proof of membership in an OHRV club shall be appropriated to the department of resources and economic development for the bureau's grant-in-aid program pursuant to RSA 215-A:23, VI.

 \t\t\t\t(2)  From the balance, $17.86 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in RSA 215-A:23, VII, and $22.98 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of fish and game for the purposes listed in RSA 215-A:23, VIII.

\t\t\t(b)  For an individual nonresident registration- [$72] $102 for each 2-wheeled trail bike registration or [$82] $112 for each other OHRV registration.  An individual nonresident registering a 2-wheeled trail bike or OHRV who provides proof, at the time of registration, that the individual is a member of an organized New Hampshire nonprofit OHRV club which is a member of the New Hampshire Off Highway Vehicle Association, shall pay $72 for each 2-wheeled trail bike registration or $82 for each other OHRV registration.

\t\t\t\t(1)  The first [$16] $46 of each 2-wheeled trail bike registration or [$26] $56 of each other OHRV registration registered by an individual who does not, at the time of registration, provide proof of membership in an organized New Hampshire nonprofit OHRV club, or $16 of each 2-wheeled trail bike or $26 of each other OHRV registration registered by an individual who provides proof of membership in an OHRV club shall be appropriated to the department of resources and economic development for the bureau's grant-in-aid program pursuant to RSA 215-A:23, VI.

\t\t\t\t(2)  From the balance, $19.95 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in RSA 215-A:23, VII, and $36.05 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of fish and game for the purposes listed in RSA 215-A:23, VIII.

\t2  OHRV Registration Fees; Residents; Club Membership.  Amend RSA 215-A:23, I to read as follows:

\t\tI.  Individual resident registration-- [$42] $72 for each 2-wheeled trail bike registration or [$51] $81 for each other OHRV registration upon presentation of a valid driver's license issued to a New Hampshire resident 18 years of age or older.  An individual resident registering a 2-wheeled trail bike or OHRV who provides proof, at the time of registration, that the individual is a member of an organized New Hampshire nonprofit OHRV club which is a member of the New Hampshire Off Highway Vehicle Association, shall pay $42 for each 2-wheeled trail bike registration or $51 for each other OHRV registration.

\t\t\t(a)  The first [$7] $37 of each 2-wheeled trail bike registration or [$16] $46 of each other OHRV registration registered by an individual who does not, at the time of registration, provide proof of membership in an organized New Hampshire nonprofit OHRV club, or $7 of each 2-wheeled trail bike or $16 of each other OHRV registration registered by an individual who provides proof of membership in an OHRV club shall be appropriated to the department of resources and economic development for the bureau's grant-in-aid program pursuant to paragraph VI.

\t\t\t(b)  From the balance, $15.30 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in paragraph VII, and $19.70 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of fish and game for the purposes listed in paragraph VIII.

\t3  OHRV Registration Fees; Nonresidents; Club Membership.  Amend RSA 215-A:23, III to read as follows:

\t\tIII.  Individual nonresident registration-- [$61] $91 for each 2-wheeled trail bike registration or [$70] $100 for each other OHRV registration.  An individual nonresident registering a 2-wheeled trail bike or OHRV who provides proof, at the time of registration, that the individual is a member of an organized New Hampshire nonprofit OHRV club which is a member of the New Hampshire Off Highway Vehicle Association, shall pay $61 for each 2-wheeled trail bike registration or $70 for each other OHRV registration.

 \t\t\t(a)  The first [$13] $43 of each 2-wheeled trail bike registration or [$22] $52 of each other OHRV registration registered by an individual who does not, at the time of registration, provide proof of membership in an organized New Hampshire nonprofit OHRV club, or $13 of each 2-wheeled trail bike or $22 of each other OHRV registration registered by an individual who provides proof of membership in an OHRV club shall be appropriated to the department of resources and economic development for the bureau's grant-in-aid program pursuant to paragraph VI.

\t\t\t(b)  From the balance, $17.10 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in paragraph VII, and $30.90 from each 2-wheeled trail bike or other OHRV registration shall be appropriated to the department of fish and game for the purposes listed in paragraph VIII.

\t4  Certification and Implementation; Effective Date.

\t\tI.  The executive director of the fish and game department shall work in conjunction with the New Hampshire Off Highway Vehicle Association to address areas of concern before the reduced fees for OHRV club membership shall take effect.  

\t\tII.  The areas of concern shall include:

\t\t\t(a)  The ability of OHRV clubs to intake club membership fees and provide accounting and oversight meeting the state's requirements.

\t\t\t(b)  Implementation of programming changes to allow for allocation of funds.

\t\t\t(c)  The potential for reduction in overall OHRV registration revenues and consideration of OHRV users that do not use the trail systems.

\t\t\t(d)  The potential for OHRV club membership cards to be confused with snowmobile club membership cards utilized under RSA 215-C:39.

\t\tIII.  If in the determination of the executive director of fish and game the areas of concern in paragraph II are sufficiently addressed on or before December 31, 2016, the executive director shall certify such determination in writing to the secretary of state and the director of legislative services, and the provisions of sections 1-3 of this act, amending RSA 215-A:21 and RSA 215-A:23, shall take effect May 1, 2017.

\t5  Effective Date.

\t\tI.  Sections 1-3 of this act shall take effect as provided in section 4 of this act.

\t\tII.  The remainder of this act shall take effect upon its passage.

SB 521-FN- FISCAL NOTE

 

AN ACT\trelative to OHRV registration fee for persons who are members of an OHRV club.

 

 

FISCAL IMPACT:

The Department of Resources and Economic Development and Fish and Game Department state this bill, as introduced, may have an indeterminable impact on state restricted revenues and expenditures in FY 2018 and each year thereafter.  There will be no impact on county and local revenues or expenditures.

 

METHODOLOGY:

This bill increases registration fees, upon certification of the executive director of the Fish and Game Department, for off-highway recreational vehicles (OHRVs) by $30 for individuals not a member of an organized New Hampshire nonprofit OHRV club which is a member of the New Hampshire Off Highway Vehicle Association, effective May 1, 2017.  The Department of Resources and Economic Development states this bill may result in the following impact on state restricted revenue given the assumptions provided:

  • Fee changes will be certified by the executive director of the Fish and Game Department, effective May 1, 2017, with FY 2018 being the first year of revenue impact;
  • There are 26,000 total registrations with 13,000 (50%) in FY 2018 and 7,800 (30%) in FY 2018 and FY 2020 not being members of an OHRV club; and
  • The $30 fee increase will be passed through entirely to the Department of Economic and Development Bureau of Trails’ grant-in-aid program pursuant to RSA 215-A:23, VI.  (Though the Department assumes the entire $30 registration increase will pass through to the Department, it has identified a potential technical issue in section 1 of the bill where the disposition of the $30 registration increase is not accounted for in its entirety.)

The Fish and Game Department states this bill may result in an increase to certain OHRV registration fees, which may result in an impact on registration sales and therefore revenue.  The Department is unable to estimate the potential revenue impact, however states when fees increase there is the potential for a decrease in registrations.  The Department estimates the first year of the new fees being in effect would result in an estimated $9,070 increase to its expenditures relative to agent education, signage, and software programming changes.

 

To the extent this bill impacts state restricted dedicated revenue, it would also likely impact corresponding dedicated expenditures.
