STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT requiring pedestrians to obey signals at railroad grade crossings.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Pedestrian Duties; Signal Indicating Approach of Train.  Amend RSA 265:34 to read as follows:

265:34  Pedestrians Subject to Traffic Signs and Regulations.  A pedestrian shall obey the instructions of any traffic sign or regulation specifically applicable to him or her, unless otherwise directed by a police officer.  Pedestrians shall be subject to traffic and pedestrian control signals as provided in RSA 265:9 unless required by local ordinance to comply strictly with such signals.  Pedestrians approaching railroad grade crossings shall comply with the requirements in RSA 265:48.  At all other places, pedestrians shall be accorded the privileges and shall be subject to the restrictions stated in this chapter.

2  Effective Date.  This act shall take effect January 1, 2018.
