This bill defines market value of stumpage for purposes of determining loss under timber trespass.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to timber trespass.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Definitions; Market Value.  Amend RSA 227-G:2 by inserting after paragraph XII the following new paragraph:

XII-a.  "Market value" means stumpage value as determined in the same manner as other property values for the purposes of taxation at the time the timber is cut.

2  Trespass; Criminal Penalty.  Amend RSA 227-J:8-a to read as follows:

II.  A person who violates the provisions of paragraph I shall be guilty of a class B felony if the loss, as determined by market value, is greater than $1,000, or a misdemeanor for any other loss.

3  Effective Date.  This act shall take effect January 1, 2018.
