AN ACT relative to smoking on private property.

ANALYSIS

 

This bill makes changes to the indoor smoking act.  Under this bill, smoking would not be prohibited in public conveyances which are privately owned, restaurants, grocery stores, and cocktail lounges.  Smoking would be prohibited in privately owned residences where the owner has declared smoking prohibited.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to smoking on private property.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Indoor Smoking Act; Definitions; Public Conveyances.  Amend RSA 155:65, XII to read as follows:

XII.  "Public conveyance'' means any air, land, or water vehicle of public access, which has enclosed sections, used for the transportation of persons in the state of New Hampshire, whether or not for compensation, including, but not limited to, airplanes, trains, buses, boats, vans, or taxis.  This definition shall not include privately owned vehicles [when used for private purposes], but shall include all vehicles owned by the state and its political subdivisions.

2  New Subparagraph; Indoor Smoking Act; Smoking Prohibited.  Amend RSA 155:66, I by inserting after subparagraph (h) the following new subparagraph:

(i)  Privately owned premises where the owner or person in charge has declared smoking is prohibited.

3  Repeal.  The following are repealed:

I.  RSA 155:66, I(c), smoking prohibited in grocery stores.

II.  RSA 155:66, I(f), smoking prohibited in restaurants.

III.  RSA 155:66, I(g), smoking prohibited in cocktail lounges.

4  Effective Date.  This act shall take effect January 1, 2018.
