STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to dedicated funds with no activity in the financial system for at least the most recent fiscal year.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

195:1  Repeal.  The following are repealed:

I.  RSA 6:12, I(b)(14), relative to moneys received for sending children to the special education program of the youth services center pursuant to RSA 186-C:20.

II.  RSA 6:12, I(b)(16), relative to money received under RSA 188-F.

III.  RSA 6:12, I(b)(18), relative to the apple marketing account under RSA 434:36.

IV.  RSA 6:12, I(b)(39), relative to duplication fees credited to the commissioner of the department of health and human services under RSA 126-A:5, X.

V.  RSA 6:12, I(b)(49), relative to the healthy kids fund under RSA 126-H:7.

VI.  RSA 6:12, I(b)(66), relative to the ginseng regulation fund under RSA 433-B:4.

VII.  RSA 6:12, I(b)(84), relative to the judicial branch salary and benefit adjustment fund under RSA 491-A:2.

VIII.  RSA 6:12, I(b)(117), relative to the nuclear decommissioning finance committee account under RSA 162-F:18.

XXIII.  RSA 6:12, I(b)(299), relative to the September 11 memorial fund under RSA 4:9-f.

195:2  Special Education Program of the Youth Services Center; Reference to Fund Removed.  Amend RSA 186-C:20 to read as follows:

186-C:20  Special Education Program of the Youth Services Center.

[I.]  Notwithstanding the provisions of any other law to the contrary, the expenses for a child with a disability receiving services at the special education program at the youth services center maintained by the department of health and human services shall be the responsibility of the liable school district so assigning the child.  Such a school district shall pay the rate established for the special education program of the center.

[II.  The special education program of the center shall receive all the moneys paid under this section and is authorized to receive and expend such funds to operate the program.  Such expenditures shall be subject to the approval of the legislative fiscal committee.]

195:3  Repeal; Community College System.  The following are repealed:

I.  RSA 188-F:9, relative to the state fund, known as the community college system of New Hampshire fund.

II.  RSA 188-F:10, relative to the nonlapsing account in the community college system.

III.  RSA 188-F:18, relative to the early childhood laboratory school fund.

195:4  Repeal; Apple Marketing Account.  RSA 434:36 and RSA 434:37, relative to the apple marketing account, are repealed.

195:5  Department of Health and Human Services; Duplication Fees.  Amend RSA 126-A:5, X to read as follows:

X.  The commissioner may assess and collect reasonable fees for the duplication of materials made pursuant to RSA 91-A:4 and for material generally available to the public upon request.  Such fees shall be based on an amount necessary to recover the cost of producing such documents, regardless of the type of medium used.  [Fees paid to the department of health and human services shall be continually appropriated to the department.] Local, state and federal agencies shall be exempted from these fees.

195:6  Repeal; Healthy Kids Fund.  RSA 126-H:7, relative to the healthy kids fund, is repealed.

195:7  Transfer of Appropriations within Judicial Branch; Reference to Judicial Branch Salary and Benefit Adjustment Fund Removed.  Amend RSA 9:17-d to read as follows:

9:17-d  Transfer of Appropriations, Judicial Branch.  The supreme court may transfer funds for any specific purposes to funds for other purposes in the general appropriations for any accounting unit within the judicial branch, provided that any transfer of $75,000 or more shall require prior approval of the fiscal committee of the general court, and provided that no funds may be transferred in violation of the provisions of RSA 9:17-a[, 491-A:2,] or any other restriction provided by law.  The judicial branch shall certify such transfers to the commissioner of administrative services.  The certification shall state that the transfers are necessary to efficiently carry out the functions of the courts and that the legislative fiscal committee has approved the transfers.  The provisions of this section shall not supersede the provisions of RSA 99:4[,] and RSA 9:17-a, I, II, [and] II-a, and IV[, and 491-A:2].

195:8  Repeal; Judicial Branch Salary and Benefit Adjustment Fund.  RSA 491-A:2, relative to the judicial branch salary and benefit adjustment fund, is repealed.

195:9  Repeal; Pollution Prevention Revolving Fund.  RSA 21-O:22, relative to the pollution prevention revolving fund, is repealed.

195:10  Repeal; Long Term Care Assistance Fund.  RSA 167:94, relative to the long term care assistance fund, is repealed.

195:11  Repeal; Local Government Records Management Improvement Program.  The following are repealed:

I.  RSA 5:47, I, relative to the definition of fund for purposes of the records management improvement program.

II.  RSA 5:48, relative to the local government records management improvement fund.

III.  RSA 5:49, III and IV, relative to duties of the local government records manager.

IV.  RSA 5:51, relative to the award of grants from the fund.

195:12  Federal Lien Registration; Reference to Fund Removed.  Amend RSA 454-B:5 to read as follows:

454-B:5 Fees.

[I.]  The fee for filing and indexing each notice of lien or certificate or notice affecting the lien shall be $30.

[II.  Fees collected under this section shall be deposited in the federal lien registration fund and allocated to the secretary of state for the purposes specified in this chapter.]

195:13  Repeal; Federal Lien Registration Fund.  RSA 454-B:5-a, relative to the federal lien registration fund, is repealed.

195:14  Repeal; Legislative Youth Advisory Council Fund.  RSA 19-K:5, relative to the legislative youth advisory council fund, is repealed.

195:15  Repeal; Comprehensive Cancer Plan Fund.  RSA 126-A:64, relative to the comprehensive cancer plan fund, is repealed.

195:16  Repeal; Regional Transportation Coordination Fund.  RSA 239-B:5, relative to the regional transportation coordination fund, is repealed.

195:17  Repeal; CART Provider and Sign Language Interpreter Net Tuition Repayment Fund.  RSA 200-M:4, relative to the CART provider and sign language interpreter net tuition repayment fund, is repealed.

195:18  Adverse Events Reporting Fund Repealed.  Amend RSA 151:40 to read as follows:

151:40  Penalties[; Fund Established].

[I.]  Any facility which violates this subdivision for failure to file a timely adverse event report or failure to conduct a root cause analysis, to implement a corrective action plan, or to provide the findings of a root cause analysis or corrective action plan in a timely fashion shall be subject to disciplinary action under this chapter and any other appropriate sanctions under this chapter.

[II  There is hereby established the "adverse events'' fund to be used to carry out the provisions of this subdivision.  The fund shall be composed of fines collected under this chapter, gifts, grants, donations, bequests, or other moneys from any public or private source and shall be used to support adverse event data collection, analysis, reporting, and education.  The fund shall be nonlapsing and shall be continually appropriated to the commissioner of the department of health and human services for the purposes of this subdivision.]

195:19  Repeal; Southeast Watershed Alliance Fund.  RSA 485-E:8, relative to the southeast watershed alliance fund, is repealed.

195:20  Repeal; September 11 Memorial Fund.  RSA 4:9-e, II(b), relative to the September 11 memorial fund, is repealed.

195:21  Effective Date.  This act shall take effect 60 days after its passage.
