STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT expanding the right-to-know law to certain motor vehicle records.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subparagraph; Motor Vehicles; Records and Certification.  Amend RSA 260:14, II by inserting after subparagraph (b) the following new subparagraph:

(c)  All sworn reports under RSA 265-A:30 shall be made available in accordance with RSA 91-A:4 in an unredacted manner.

2  Effective Date.  This act shall take effect 60 days after its passage.

*Pursuant to Part II, article 6-a of the New Hampshire constitution, any costs associated with the collection and administration of Highway Funds by the Department of Safety shall be deducted by the Department before such funds are credited to the Highway Fund as unrestricted revenue.

 

METHODOLOGY:

The Department of Safety assumes reports would be made available at a cost of $1 per page as is the case with other requests made under RSA 91-A.  The resulting revenue would be treated in a "cost of collections" manner; with the revenue supporting associated costs with any remaining revenue credited to the Highway Fund as unrestricted revenue.  Currently, records under RSA 260:14 are made available with consent or appropriate permission and the Department is authorized to charge reasonable fees which are deposited in the Fire Standards and Training and Emergency Medical Service Fund (Fire and EMS Fund).  The Department assumes if this information is made available via a right to know request, it will not be requested as a release of motor vehicle records and the associated Fire and EMS Fund revenue would decline.  Lastly, the Department expects there would be costs associated with of the requested information.  The Department cannot determine these costs since the number of possible requests is not known.
