STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT establishing a municipal opioid reversal agent bulk purchase fund.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Opioid Reversal Agent Bulk Purchase Fund.  Amend RSA 7 by inserting after section 6-f the following new section:

7:6-g  Disposition of Funds Received for Opioid Reversal Agents.

I.  There is established within the office of the state treasurer a separate, nonlapsing fund to be known as the municipal opioid reversal agent bulk purchase fund administered and expended by the attorney general, or designee.  Any funds received by the department of justice as a result of the agreements with manufacturers of opioid reversal agents shall be deposited into the municipal opioid reversal agent bulk purchase fund.  The fund shall be used to increase the access for municipalitys' police and fire departments and non-profit first responder organizations and school departments to opioid reversal agents through a discounted purchase price program.  The fund shall be continually appropriated to the department of justice for the purposes of this section.

II.  The fund shall consist of:

(a)  Payments made by participating municipalities for the purchase of an opioid reversal agent.

(b)  Revenue from appropriations or other moneys authorized from the general fund.

(c)  Funds from public or private sources, including, but not limited to gifts, grants, donations, rebates and settlements received by the state specifically designated to be credited to the fund.

III.(a)  Funds received under subparagraphs (b) and (c) of paragraph II shall be apportioned in a manner determined by the department of justice and shall be applied to provide price reductions for municipalities purchasing an opioid reversal agent through the program.

(b)  Amounts credited to the fund shall not be subject to further appropriation and moneys remaining in the fund at the end of the fiscal year shall not revert to the general fund.

2  New Subparagraph; Special Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph 333 the following new subparagraph:

(334)  Moneys received by the department of justice under RSA 7:6-g, II, which shall be deposited in the municipal opioid reversal agent bulk purchase fund established in RSA 7:6-g.

3  Effective Date.  This act shall take effect July 1, 2017.

METHODOLOGY:

This bill would create a dedicated fund for the bulk purchase of narcan and naloxone.  The fund would be used to increase access to opioid reversal agents for municipal police and fire departments, non-profit first responder organizations and school departments.  The fund would supported by public and private sources, including, but not limited to gifts, grants, donations, rebates, and funds from agreements or settlements received by the Department of Justice specifically designated for the fund.  Through bulk purchasing, the fund would make the opioid reversal agents available at a discounted price.  The Department of Justice does not currently have any agreements for such funds.  To the extent agreements were reached as contemplated by the  bill, any funds would be deposited in the dedicated fund for the purposes described.  The Department has not identified any additional fiscal impact aside from potential revenue to and expenditures from the municipal opioid reversal agent bulk purchase fund.
