AN ACT relative to information available to members of school boards or budget committees.

ANALYSIS

 

This bill requires that each member of a budget committee and each member of a school board in a school administrative unit are entitled to all necessary information to perform his or her duty.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to information available to members of school boards or budget committees.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Budget Committee; Authority; Information.  Amend RSA 32:16, II to read as follows:

II.  To confer with the governing body or bodies and with other officers, department heads and other officials, relative to estimated costs, revenues anticipated, and services performed to the extent deemed necessary by the budget committee.  It shall be the duty of all such officers and other persons to furnish such pertinent information to each member of the budget committee.  The members of the budget committee shall be entitled to all information necessary to  perform their duties under this chapter.

2  Budget Committee; Statements; Necessary Information.  Amend RSA 32:17 to read as follows:

32:17  Duties of Governing Body and Other Officials.  The governing bodies of municipalities adopting this subdivision, or of districts which are wholly within towns adopting this subdivision, shall review the statements submitted to them under RSA 32:4 and shall submit their own recommendations to each member of the budget committee, together with all information necessary for the preparation of the annual budget, including each purpose for which an appropriation is sought and each item of anticipated revenue, at such time as the budget committee shall fix.  In the case of a special meeting calling for the appropriation of money, the governing body shall submit such information not later than 5 days prior to the required public hearing.  Department heads and other officers shall submit their departmental statements of estimated expenditures and receipts to each member of the budget committee, if requested.

3  School Board; School Administrative Unit; Necessary Information.  Amend RSA 194-C:5, III to read as follows:

III.  The school board of each school administrative unit shall fix the salaries of all school administrative unit personnel, shall apportion the expense of the salaries and benefits among the several districts, and shall certify the apportionment to their respective treasurers and to the state board of education.  In order to perform such duties, each member of the school board shall, upon request, be provided with all necessary information related to the compensation and benefits of school district personnel and school administrative unit personnel.  The school administrative unit board shall have the authority to remove superintendents and other administrators.

4  Effective Date.  This act shall take effect 60 days after its passage.
