1 New Section; Children in Need of Services; Placement at Sununu Youth Services Center. Amend RSA 169-D by inserting after section 5-c the following new section:

169-D:5-d Voluntary Service Plan; Placement at Sununu Youth Services Center. If a child 14 to 17 years old is administered Narcan by a law enforcement officer, firefighter, or other first responder for a heroin overdose, the officer shall file a petition under RSA 169-D:5, I and the child shall be referred for placement at the Sununu Youth Services Center. If the department of health and human services determines that placement at the center is appropriate for the education and treatment of the child, and the child's parent or guardian consents to the placement, the child may be placed at the Sununu Youth Services Center pursuant to a voluntary service plan, approved by the court, for a period of not more than 10 months or one school year. If the department determines that placement at the center is not appropriate, the department shall document the basis for its decision. The underlying petition shall be stayed pending the child's placement at the Sununu Youth Services Center and either dismissed or brought forward upon the child's discharge from the center.

2 Effective Date. This act shall take effect January 1, 2018.
