STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT requiring the state park system to use competitive bidding for the acquisition and resale of firewood.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Department of Administrative Services; Purchase of Supplies.  Amend RSA 21-I:18, I(e) to read as follows:

(e)  Except as provided in RSA 216-A:2, the purchase of materials, supplies, and merchandise by the department of resources and economic development as provided by RSA 219:21 shall not be subject to the provisions of this chapter.

2  New Paragraph; Duties of the Director of Parks and Recreation.  Amend RSA 216-A:2 by inserting after paragraph VI the following new paragraph:

VI-a.  The director shall comply with the competitive bidding requirements of RSA 21-I for the purchase and sale of firewood.  

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires the Department of Resources and Economic Development (DRED) to outsource the purchase and sale of firewood used at state parks and campgrounds through the competitive bid process.  In April 2016, DRED entered into an agreement with the Department of Corrections (DOC) in which DOC will provide DRED with kiln dried firewood at a $0.35 discount per bundle for a five year term or on the first 150,000 bundles delivered.  DRED purchases approximately 30,000 bundles annually at $3.75 from DOC and assumes it would pay other vendors $4.10 per kiln dried bundle.  DRED states it would forego approximately $10,500 annually in cost savings if it were to pay another vendor $4.10 per bundle (($4.10-$3.75 ) * 30,000 = $10,500).  Relatedly, the DOC would experience a decrease in revenue of approximately $112,500 annually, assuming 30,000 bundles were sold to DRED (30,000 * $3.75 = $112,500).      

 

The Department of Administrative Services states the amount of bids for firewood is minimal and no significant financial impact is anticipated.  

 

RSA 622:28 requires all departments and agencies to purchase articles and supplies from the state prisons if the Department of Administrative Services determines that such purchases may be made at fair market value.  It is not clear whether this existing statute and the proposed bill would be in conflict.
